Terms of Service

By commissioning me, you are agreeing to the following terms.
Please read carefully before placing an order.


GENERAL
• Commissions are for Personal Use only unless commercial rights are purchased. (Additional fees apply depending on service.)
• My artwork may be used for personal display such as profile pictures, banners, posting on Socials with Credit, or printing for yourself, but may not be used for profit without prior agreement.
• Al/NFT use is strictly prohibited. My work may not be used in Al datasets, engines, or minted as NFTs.
• I reserve the right to decline commissions outside my abilities or for subjects I will not draw.
• Communication is important. If I do not receive a response within 1 week, I will proceed and deliver the artwork as is.
• You receive 2 free revisions (sketch stage only). Additional revisions cost $15 each, paid before I continue. Please provide all feedback at the sketch stage.
• Gift art you receive from me has a value of $0 USD and maintains the same rights as a commissioned piece.


PAYMENTS & FEES
• All payments are upfront in full through the agreed platform.
• Payment plans may be available upon discussion, and if a plan is agreed upon, I will not begin the artwork until the plan is paid in full.
• A Non-Disclosure Agreement (NDA) fee of $100 applies if you request that I do not post your commission publicly or use it as part of my Portfolio.
• Complexity Fees can we applied by my discretion as an artist. Depending on the piece, they will range between $10-100 for all Commissions.


REVISIONS
• Revisions are only available during the sketch phase.
• Once sketches are approved, no further changes will be made unless due to an error on my part. Mistakes I make will always be corrected at no cost (example: forgetting an accessory)


DEADLINES AND DELIVERY
• Commissions may take up to 2 month depending on complexity. queue, health, school, or personal matters.
• I will keep you updated if delays occur.
• If you wish to skip the Queue and be Priority, the fee will be $10
USD.
• If you need a piece done by a specific date, the fee will be $10 USD minimum. This fee will fluctuate depending on how urgently the piece needs to be done.


INTELLECTUAL PROPERTY RIGHTS
I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself.
I may use the artwork to:
-Promote myself and my services.
Post on social media and in my portfolio.~
-Create prints/merchandise (for fanart commissions only)~

If an NDA was purchased, the artwork will not be posted or used for promotional purposes.}


REFUNDS
• I may cancel and refund a commission at any time.
• You may cancel before payment is made.
• Once payment is received, refunds are not available.
• Chargebacks are strictly prohibited.

• Forfeit your rights to use the artwork.
• Place you on a public blacklist (with evidence).
• Allow me to resell or reuse the artwork as I see fit.
• Result in a formal complaint against you on applicable websites (example: Toyhou.se)}


COMMISSIONER RIGHTS
You may:
• Use the artwork for personal purposes only (unless commercial rights are purchased).
• Print the art for yourself.
• Post it on Social Media with credit to me " @dozyoaf "
You may NOT:
• Use the artwork commercially without permission.
• Claim the artwork as your own or fail to credit me.
• Remove signatures/watermarks.
• Resell or redistribute the artwork.
• Modify the artwork without my consent.
• Use artwork purchased for Personal Use in merch, streaming, or commercial projects.


BLACKLIST POLICY
• Breaking these rules may result in a permanent public blacklist (with evidence).
• The blacklist may be shared with other artists.
• The blacklist will be visible to other users on applicable social media (example: Toyhou.se)


FINAL AGREEMENT
• By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms above.
